What does the LkSG and CSDDD have in common?


If you've already implemented the #LkSG (the German Supply Chain Act), are there any synergies to the upcoming #CSDDD (The Corporate Sustainability Due Diligence Directive)? 


The global regulatory landscape for supply chain due dilligence is evolving fast - especially within the EU. 


This has a lot of companies wondering how to organize efforts across legislations like the CSDDD, CSRD, LksG, Deforestation act, Modern Slavery act, and much more. 


In our recent webinar with Ingo Theusinger from Noerr, one of Europe's leading law practices, we discussed the synergies between the LkSG and upcoming CSDDD in particular. 


The takeaway? 


👉 Due diligence obligations and risk-based approach are similar, which means that the same "methodology" can largely be used.


👉 Lots of overlap in topics. I.e. if you've already tackled e.g. #forcedlabor with Responsibly for the LkSG, you can reuse this approach for tackling forced labor in the CSDDD, the UK Modern Slavery Act, Californian transparency act, and so on.


👉 Also some complementarity in topics. The CSDDD looks to be broader in scope than the LkSG, especially on the environmental side. So either you'll need to expand your analytical lens, or you use a tool from the beginning that includes these topics.
